RELEASE OF LIABILITY & INDEMNIFICATION Participant agrees to indemnify, defend, and hold harmless:
Ninja Elimination Series, LLC ("NES"), its owners, officers, directors, members, managers, employees, contractors, volunteers, agents, representatives, sponsors, partners, host facilities, venue operators, event staff, and affiliated organizations... ...and any and all other persons or entities acting in any capacity on behalf of NES. ...from any and all claims, demands, actions, causes of action, damages, losses, costs, expenses (including reasonable attorney fees), and liabilities of every kind and nature, whether known or unknown, arising out of or in connection with Participant's participation in any NES event, including but not limited to claims for personal injury, death, property damage, or any breach of this waiver.
This release is governed by the laws of the State of Arizona and applies to the fullest extent permitted by law, excluding gross negligence or willful misconduct.
REQUIRED ACKNOWLEDGMENTS CHECK ALL All 17 acknowledgments must be checked to proceed.
01. I voluntarily choose to participate in NES competitions.02. I understand and assume all inherent risks associated with participation.03. I understand competitions use a double elimination bracket format with head-to-head racing.04. I understand division format and policies are governed by the official NES Rulebook.05. I acknowledge that placement, seeding, awards, and finals qualification are determined by the official NES Rulebook.06. I certify that I am physically fit and medically able to participate.07. I acknowledge the risk of dehydration and heat illness due to Arizona climate conditions.08. I agree to report all injuries immediately to NES staff.09. I authorize NES staff to provide first aid and seek emergency medical treatment if necessary.10. I understand NES does not provide medical insurance coverage.11. I acknowledge the risk of exposure to communicable diseases.12. I grant NES irrevocable rights to photograph and use my likeness worldwide in perpetuity without compensation.13. I release and hold harmless Ninja Elimination Series, LLC ("NES"), its owners, officers, directors, members, managers, employees, contractors, volunteers, agents, representatives, sponsors, partners, host facilities, venue operators, event staff, affiliated organizations, and any and all other persons or entities acting in any capacity on behalf of NES, from liability, including negligence, to the fullest extent permitted by Arizona law (excluding gross negligence or willful misconduct).14. I agree to indemnify, defend, and hold harmless Ninja Elimination Series, LLC ("NES"), its owners, officers, directors, members, managers, employees, contractors, volunteers, agents, representatives, sponsors, partners, host facilities, venue operators, event staff, affiliated organizations, and any and all other persons or entities acting in any capacity on behalf of NES, from any and all claims, damages, losses, or expenses arising from my participation or any breach of this waiver.15. I agree that disputes will be resolved through binding arbitration in Maricopa County, Arizona, and waive my right to a jury trial.16. I understand this waiver applies to all NES events unless superseded by local law.17. I understand that if any provision is unenforceable, the remainder remains valid.
